Mediation

Mediation is another process that assists people to resolve their disputes respectfully, peacefully and privately.

A trained Mediator can assist the parties by facilitating the communication between them and by helping  them develop options for resolving their dispute.

A couple may chose to attend mediation with a mediator but no lawyers present. This model is used widely at Relationships Australia, Family Relationship Centres  and is also available through our office. If you wish to go to Court and your case involves a child dispute, you will have to attend a compulsory mediation before you will be able to commence your Court case.

Mediation with legal advice is the other option, where the parties and their lawyers all attend the mediation together.  Catherine Gale is a trained Mediator and is happy to work with the parties and their lawyers in this way to help them achieve a peaceful resolution of their dispute.

As a general rule it is preferable for the parties to have the benefit of legal advice  whilst in the mediation process, so that they do  not put themselves in a situation where an agreement is reached in Mediation, but subsequently falls apart because a party to it changes their mind after receiving legal advice, whilst the agreement is being put into a legally binding form.

Remember a  Mediator cannot give legal advice even if they are legally trained.
