Divorce Lawyers Melbourne

You can’t always choose whether or not you want to divorce, but you can choose how well or badly you do it.

Divorce happens to other people. Our relationship/marriage is for good – or so we often think. But sometimes a relationship becomes intolerable, other times our partner breaks up the relationship for reasons we may not fully understand – and we face the prospect of separation and divorce.

Catherine Gale helps clients navigate the separation and divorce process, explaining the pros and cons of the different options that are available to assist in the resolution of their family law matter.

We discuss the legal and factual issues involved in your case, as well as the need to consider the costs of various divorce methods, both financial and emotional.

Perhaps most importantly, we understand that a relationship/ marriage breakup is one of the most traumatic experiences that someone can have. We try to provide an objective and reasonable voice to our clients to steer them toward a timely, cost effective outcome that will meet their needs and interests as well as those of their former partner.

What option should you choose?

The most simple path to resolution is for you and your partner to reach a “kitchen table” agreement and then find lawyers who can turn it into a legally binding document. About 5% of people successfully use this process.
Another 5% of cases end up being determined by the court although a lot more start out in the Court process, but reach agreement along the way, often, literally at the door of the Court.

Available Options:-

For the other 90% - those who can’t sort it out between themselves and those who do not want to go to Court - there are several options which include:-

  1. Collaborative Law is a process where specially trained lawyers work with both parties without the threat of Court intervention.
  2. Constructive Negotiation process a process involving negotiation between your lawyers, using correspondence and round table conferences.
  3. Mediation uses a neutral professionally trained mediator to facilitate settlement discussions between the parties

Please contact Catherine Gale to discuss your options and schedule a time to meet.
